General Terms and Conditions

The site www.einladungstore.de is operated by the company ORES Vertriebs - und Verwaltungs GmbH (see Imprint). 

1. Scope of the GTC

1.1 Upon conclusion of the contract (Section 2. of these General Terms and Conditions), the following General Terms and Conditions shall become an integral part of the contract between ORES International Vertriebs und Verwaltungs GmbH, Marientaler Str. 83, 38350 Helmstedt, and the customer.

1.2 The Provider shall provide its services exclusively on the basis of these General Terms and Conditions.

1.3 Orders/inquiries: Please use the store system of the website, the app or contact us by telephone via our service via WhtasApp.

1. Conclusion of the contract

2.1 The information provided on the website einladungstore.de by the provider contains an offer to the customer to submit a contract offer.

2.2 The Customer submits a corresponding contract offer for the chargeable print order on the website www.hochzeitseinladungen.de by entering all the data required for the conclusion of the contract, in particular the card desired by him, the design and personal specifications of the cards desired by him, his first and last name, his complete residential address, his e-mail address, his mobile number and his date of birth in the store system of www.einladungstore.de and sending the completed form to the Provider electronically via the website or the app. If the Customer only wishes to make a non-binding inquiry to the Provider without entering into a commitment to purchase, the Customer can contact the live chat on the Website, via email, social media or the WhatsApp service. 

2.3 The Provider reserves the right to reject the contractual declaration contained in the completed order form. Contractual declarations by persons under the age of 18 shall be rejected as a matter of principle.

2.4 The dispatch and sale of the printed cards is carried out in the name and for the account of ORES International Vertriebs und Verwaltungs GmbH, Vorsfelder Strasse 54, 38350 Helmsted.

Widerrufsrecht

You can revoke your contractual declaration in text form (e.g. letter, fax, e-mail) within 14 days without giving reasons. The period begins after receipt of this instruction in text form, but not before conclusion of the contract and also not before fulfillment of our information obligations pursuant to Article 246 § 2 in conjunction with § 1 para. 1 and 2 EGBGB and our obligations pursuant to § 312e para. 1 sentence 1 BGB in conjunction with Article 246 § 3 EGBGB. Timely dispatch of the revocation is sufficient to comply with the revocation period. The revocation is to be sent to:

Widerrufsfolgen

In the event of an effective revocation, the services received by both parties must be returned and any benefits derived (e.g. interest) surrendered. Sketches, drafts, test prints, samples and similar work initiated by the client can therefore be invoiced even if the print order is canceled d.h. You exercise your right of withdrawal. Likewise,  the procurement costs incurred up to that point with third parties may be charged, z.B. Special paper that was ordered specifically at your request and is not in stock with us. We naturally have the standard paper types in stock.

If you are unable to return the service received in whole or in part or only in a deteriorated condition, you may have to reimburse us for this. Pay compensation. This may mean that you still have to fulfill the contractual payment obligations for the period up to the revocation. Obligations to reimburse payments must be fulfilled within 30 days. The period begins for you with the dispatch of your declaration of revocation, for us with its receipt.

In the event that the customer makes use of his right of revocation, he must bear the regular costs of the return shipment if the delivered goods correspond to those ordered and if the price of the item to be returned does not exceed an amount of 40 euros or if the customer has not yet provided the consideration or a contractually agreed partial performance at the time of revocation in the case of a higher price of the item. Otherwise the return shipment is free of charge for the customer.

Besondere Hinweise

Your right of withdrawal expires prematurely if the contract has been completely fulfilled by both parties at your express request before you have exercised your right of withdrawal.

End of the withdrawal policy

1. Information on individual provisions of the contract

Our currently valid General Terms and Conditions apply. Features of the services and prices are described directly in connection with the service offered. The contract between you and us is concluded as follows: You enter the required data (desired print job, name, address, e-mail address and date of birth) in the registration mask. You can change the order data  at any time until the order is sent. Changes can be made using the mouse and/or keyboard. After clicking the "Order" button, you make a binding declaration to ORES Vertriebs - und Verwaltungs GmbH regarding the order of a print job. At the same time, you accept our General Terms and Conditions.

1. Korrekturabzüge/Satzfehler

The Provider shall send the Customer a proof of the cards in PDF format by email within 1-3 or 7-10 days (depending on the workload) of receipt of the Customer's order, depending on the delivery time selected. Proofs and press proofs must be checked by the customer for typesetting and other errors and returned ready for printing. The supplier is not liable for errors that the customer has overlooked, except in the case of intent on the part of the supplier. The Provider may, but is not obliged to, resubmit the proof to the Customer for further correction in the event of errors obviously overlooked by the Customer. 

6.Toleranzen

Minor color deviations (+/- 10%), differences in position (= positioning of the print and cut), quality fluctuations due to the technical conditions at the respective paper manufacturer and/or the different printing processes and paper types cannot be excluded. We reserve the right to slight deviations in quality and design due to the manufacturing process (partly manual work). Deviations in color and opacity, especially with textured papers, cannot be ruled out. Minor over- or under-deliveries are permissible for technical reasons and may be invoiced (+/-10%).
As small scratches may occur during printing on the transparent products due to the technical printing conditions, we recommend other variants with better quality to our customers, supported by photos. These tolerances correspond to the current state of the art and are customary in the printing industry or correspond to commercial practice in the printing industry. Tolerances are excluded in the case of intent or gross negligence. These deviations also apply in particular to reprint orders.

1. Payment methods, delivery times, prices, shipping costs

7.1 Payment shall be made upon delivery depending on the desired payment method (cash on delivery/credit card, SOFORT, PayPal). Shipping and packaging costs will be charged separately. 

7.2 Lieferzeiten

The standard delivery time can be selected by the customer. The shipment is ready for dispatch within 3-10 or 14-21 days. The delivery itself takes 3 - 7 working days (within the EU) from receipt of the print approval (imprimatur) on the following working day. The stated date refers to the dispatch of the delivery, provided that we ourselves are supplied correctly and on time; the supplier cannot be held liable for exceeding the delivery time by the manufacturer/transporter or by force majeure, except in the case of intent or gross negligence. 

7.3 The prices quoted by the Supplier are final prices, d.h. They include all price components, including statutory VAT. Any additional shipping costs incurred are indicated separately in the respective product offer. 

Outside Germany, different shipping costs apply depending on the country, please ask for the shipping costs to the desired country of delivery if necessary.

For deliveries to countries outside the European Union, additional costs may be incurred in individual cases, such as z.B. additional taxes and/or duties, for example in the form of customs duties. These costs depend on the country and can be requested in advance from the supplier, please ask the responsible customs office directly for the amount of these costs.

7.4 If delivery to the customer is not possible, the freight forwarder commissioned by the seller shall return the goods to the seller, whereby the customer shall bear the costs for the unsuccessful delivery, insofar as he is responsible for the unsuccessful delivery. This does not apply if the seller has given the customer reasonable advance notice of the delivery or if the customer exercises his right of withdrawal by returning the goods.

7.5 If advance payment is agreed, payment is due immediately after conclusion of the contract.

7.6 In the event of defects arising from or during delivery, we shall be liable for reimbursement in the form of new goods.

7.7 The products are produced outside of Germany and shipped to our distribution center. From there, the order is sent to the end customer. 

1. Gewährleistung

The statutory warranty rights apply. In the event of a complaint, please contact the supplier in writing. The supplier reserves the right, at its discretion, to repair the goods and/or to supply a replacement or to reimburse the costs. If the defect is to be rectified, this shall be done within a reasonable period of no more than 14 working days from the time we discover the defect. This should always be done in consultation with the customer, as we want to satisfy every customer. For this purpose, the defects in the products must be documented with photos.  

1. Liability of the supplier

9.1 The Provider shall only be liable for damages other than those resulting from injury to life, body and health insofar as these are based on intentional or grossly negligent action or on culpable breach of a material contractual obligation by the Provider, its employees or its vicarious agents. This also applies to damages arising from the breach of obligations during contract negotiations and from the performance of unauthorized acts. Any further liability for damages is excluded.

9.2 Except in the case of intentional or grossly negligent conduct, breach of a cardinal obligation or injury to life, limb or health by the provider, its employees or vicarious agents, liability shall be limited to the damages typically foreseeable at the time of conclusion of the contract and otherwise to the amount of average damages typical for the contract. This also applies to indirect damages, in particular loss of profit.

9.3 The provisions of the product liability laws remain unaffected.

1. Copyright

All rights to texts and images belong to the provider or its authorized representatives. Any further use by third parties requires prior permission.

1. Severability clause

Should individual provisions of these GTC be or become invalid in whole or in part, or should the contract contain a loophole, the validity of the remaining provisions or parts of such provisions shall remain unaffected. The invalid or missing provisions shall be replaced by the respective statutory provisions

We use your data exclusively to process your order. The data will not be passed on to third parties (with the exception of our service providers for the purpose of contract processing z.B. Versandunternehmen). 

For our own advertising purposes, we may display the cards ordered on our homepage and/or exhibit them at trade fairs. If you do not wish this, please let us know and your last name or address will be made unrecognizable.
